Copyright and DMCA Policy

BookyDate.com (“BookyDate”, “we”, “us”, “our”) respects the intellectual property rights of others and expects the people who use BookyDate.com and its related interfaces (the “Site”) to do the same. This Policy explains how a copyright owner, or someone authorized to act for one, can notify us of material on the Site that they believe infringes their rights, how affected users can respond, and how we deal with repeat infringers.

BookyDate is operated from Rua Senador Dantas 117, 20031-204 Rio de Janeiro, Brazil. We follow a notice-and-takedown process modeled on the United States Digital Millennium Copyright Act (DMCA), and we also act on valid complaints under applicable Brazilian and other copyright law. Nothing in this Policy is legal advice.

1. Our commitment

We remove or disable access to material that is the subject of a valid infringement notice, and in appropriate circumstances we terminate the accounts of users who repeatedly infringe. Sending or responding to a notice does not create any obligation on us beyond what applicable law requires.

2. How to report alleged copyright infringement

If you own a copyright, or are authorized to act on behalf of the owner, and you believe that material on the Site infringes that copyright, please send us a written notice that includes all of the following:

A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or, if a single notice covers several works, a representative list of those works.
Identification of the material claimed to be infringing that you want removed or disabled, with enough detail for us to locate it, such as the profile, URL, or message where it appears.
Your contact information, including your full name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

3. Where to send your notice

To speed up processing, please use email and write “Copyright Notice” in the subject line. Incomplete notices may delay or prevent action.

4. What we do with a valid notice

When we receive a notice that meets the requirements above, we may remove or disable access to the material, notify the user who posted it, and give that user a copy of the notice. We may also keep a record of the notice for our repeat-infringer process.

5. Counter-notification

If your material was removed or disabled and you believe this happened because of a mistake or misidentification, you may send us a counter-notification that includes all of the following:

Your physical or electronic signature.
Identification of the material that was removed or disabled and the location where it appeared before it was removed or disabled.
A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
Your full name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of a competent court and will accept service of process from the party that filed the original notice or its agent.

6. What happens after a counter-notification

If you send a valid counter-notification, we may forward it to the person who filed the original notice. Unless that person informs us that they have started a court action to keep the material down, we may restore the removed material within a reasonable time. Timeframes and procedures follow applicable law.

7. Repeat infringers

We have a policy of terminating, in appropriate circumstances and at our discretion, the accounts of users who are repeat infringers. We may also restrict access to or remove content at any time, with or without notice, for conduct we reasonably consider to be infringement or a violation of our Terms.

8. Misrepresentations

Under applicable law, a person who knowingly makes a material misrepresentation that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and legal fees. Please make sure your notice or counter-notification is accurate before you send it.

9. Trademark and other intellectual property

If you believe content on the Site infringes a trademark or another intellectual property right rather than a copyright, contact us at legal@bookydate.com with a clear description of the right you hold, the allegedly infringing material and its location, and your contact details. We will review your complaint under applicable law.

10. Changes to this Policy

We may revise this Policy from time to time. We will post the updated version on this page with a new revision date. Please review this page periodically.
